These Terms of Use govern your access to and use of the FAPPNY website and directory service ("the Service") operated by FAPPNY ("we", "us", "our"). By using the Service you agree to these terms. If you do not agree, please do not use the Service.
1. About the Service — directory only
FAPPNY is an online directory of verified property professionals operating in the United Kingdom. The Service is a referral and information platform only. We are not an agent, employer, contractor, or representative of any professional listed on the Directory. We are not a party to any contract, agreement, or transaction between a professional and a member of the public.
The Directory is exclusively for professionals working in the UK property sector — including surveyors, conveyancers, engineers, tradespeople, and specialist property consultants. It is not a general trades directory.
2. Use of the directory — members of the public
You may use the directory to:
- Search for verified property professionals by location and profession type
- View professional profiles, credentials, and contact details
- Submit quote requests via the "Get a Quote" form on a professional's profile
You must not:
- Use the Service for any unlawful purpose or in any way that violates applicable law
- Submit false, misleading, or fraudulent quote requests or enquiries
- Post or submit fake reviews, testimonials, or endorsements
- Attempt to scrape, harvest, or systematically extract data from the directory
- Use automated tools to access or interact with the Service without our prior written consent
- Attempt to interfere with or disrupt the Service or its infrastructure
- Use the Service to send unsolicited commercial communications (spam) to listed professionals
2A. Acceptable use policy (AUP)
The following conduct is strictly prohibited and may result in immediate suspension of your access to the Service, removal of any submitted content, and (where appropriate) referral to law enforcement or regulatory authorities:
- Data harvesting: Using bots, scrapers, crawlers, or any automated means to extract professional contact details, business information, or any other data from the directory
- API misuse: Accessing any FAPPNY API endpoint beyond the scope of normal browsing, or attempting to reverse-engineer the platform's systems
- Fraudulent enquiries: Submitting quote requests or contact forms under a false identity, or for the purpose of harvesting professional contact details rather than obtaining a genuine quote
- Credential misuse: Attempting to access another user's account, or exploiting any vulnerability in the authentication system
- Platform interference: Attempting to overload, disrupt, or compromise the security or integrity of the Service's infrastructure
We reserve the right to block access from any IP address or device that we reasonably believe is being used in breach of this policy, without prior notice.
3. Professional listings — no endorsement or guarantee
Professionals listed on the directory have been subject to our verification process at the time of their application. Verification confirms that documents submitted appear genuine and that stated memberships and registrations were active at the time of review. It does not constitute an endorsement, recommendation, or guarantee of the quality of any professional's work or the outcome of any engagement.
FAPPNY is an information directory only. We are not a regulated firm, estate agency, surveying practice, or professional body. Listing on this directory does not mean that a professional is currently registered, insured, or in good standing with their regulatory body.
You are responsible for conducting your own due diligence before engaging any professional. This includes — but is not limited to:
- Checking the professional's current registration status directly with the relevant regulatory body (for example: RICS at ricsfirms.com or the RICS member directory; RPSA at rpsa.org.uk; SRA at sra.org.uk; FCA at register.fca.org.uk)
- Confirming that their professional indemnity and public liability insurance is current and adequate for the work you require
- Verifying that any redress scheme membership (e.g. TPO or PRS) is active, where applicable
- Obtaining and reviewing written terms of engagement before instructing any professional
We do not warrant that any professional is currently registered, insured, or compliant with their regulatory obligations at the time you contact them. Verification is carried out at the time of application and at annual renewal — it is not a real-time check.
Listing information is provided by professionals themselves. We take reasonable steps to verify key details but cannot guarantee the accuracy, completeness, or currency of all information displayed. We are not liable for any loss arising from your reliance on information in a Listing.
4. Professional accounts and listings
If you apply to list your services on the directory, your application and Listing are also governed by our Terms of Business for Professionals, which set out the full obligations, fee structure, and monetisation terms that apply to your Listing. In the event of any conflict between these Terms of Use and the Terms of Business for Professionals, the Terms of Business for Professionals shall prevail in respect of your Listing.
In summary, as a listed professional you agree to:
- Provide accurate, complete, and up-to-date information at all times
- Upload only genuine documents that relate to your own credentials
- Notify us promptly of any change to your regulatory status or insurance
- Maintain your listing in good standing and respond to renewal requests within the stated timeframe
- Not impersonate another professional or business
- Not post fake reviews or engage in any misleading or deceptive practice
- Comply with all applicable laws and professional regulatory requirements
We reserve the right to suspend, pause, or remove any listing at our sole discretion, including where we have reason to believe that information provided is inaccurate, misleading, or where a professional's regulatory status has lapsed or is under investigation.
5. User conduct — prohibited content
You must not submit, post, or transmit through the Service any content that:
- Is unlawful, defamatory, fraudulent, or misleading
- Infringes the intellectual property rights of any third party
- Contains malware, viruses, or any harmful code
- Constitutes spam or unsolicited commercial communications
- Impersonates any person or entity
- Violates any applicable data protection or privacy law
We reserve the right to remove any content that breaches these rules without notice, and to suspend or terminate access to the Service for any user who repeatedly or seriously breaches them.
6. Account security
You are responsible for maintaining the confidentiality of your portal login credentials. You must notify us immediately at [email protected] if you suspect unauthorised access to your account. We are not liable for any loss or damage arising from your failure to keep your credentials secure.
7. Intellectual property
All content on the Service that is not provided by professionals — including the site design, layout, text, graphics, and software — is owned by or licensed to us and is protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
By submitting content to the Service (including your professional biography, business details, and any other listing information), you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to host and display that content on the Service for the purpose of operating the directory. This licence survives the removal of your Listing to the extent required for legal, compliance, and audit purposes.
8. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or suitability of any information on the Service for any particular purpose.
In particular, we do not warrant that any professional listed on the Directory is currently registered, insured, or compliant with their regulatory obligations. Verification is carried out at the time of application and at annual renewal — it is not a real-time check.
9. Limitation of liability
The Service is provided free of charge to members of the public. To the fullest extent permitted by law, our total aggregate liability to you arising out of or in connection with your use of the Service shall not exceed £50.
We exclude all liability for any direct, indirect, incidental, special, or consequential loss or damage arising from:
- Your use of or reliance on the Service
- Your reliance on any professional found through the directory
- Any dispute between you and a professional you contacted through the directory
- Any inaccuracy in a professional's Listing information
- Any loss arising from engaging a professional whose credentials have lapsed since verification
- Any interruption, suspension, or termination of the Service
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
10. Third-party links
Professional profiles may include links to external websites (including the professional's own website and Google Reviews). We are not responsible for the content, accuracy, or practices of any third-party websites and your use of them is at your own risk.
10A. Company disclosures (Electronic Commerce Regulations 2002)
In accordance with Regulation 6 of the Electronic Commerce (EC Directive) Regulations 2002, the following information is provided about the operator of this Service:
- Operator: Pole Star Property Services Ltd (trading as FAPPNY)
- Registered in: England and Wales
- Registered office: As displayed in the footer of this website
- Regulatory status: Pole Star Property Services holds its own professional registrations as a building surveying consultancy; those registrations do not extend to or cover the FAPPNY directory product. FAPPNY operates as a listing and referral platform and is not itself a regulated firm in that capacity.
Company registration number and VAT number (where applicable) are displayed in the footer of this website in accordance with the above Regulations.
10B. Notice and takedown — illegal or non-compliant content
We operate a notice and takedown procedure in accordance with the Electronic Commerce (EC Directive) Regulations 2002. If you believe that any content on the FAPPNY directory is illegal, fraudulent, or otherwise non-compliant, you may report it using our Report Illegal Content page.
Upon receiving a valid report, we will:
- Acknowledge receipt within 2 business days
- Investigate the report and take appropriate action within 5 business days
- Remove or disable access to content that we determine to be illegal or in breach of our Terms
- Notify the reporting party of the outcome, subject to any legal constraints on disclosure
We reserve the right to refer reports involving suspected criminal activity to the relevant law enforcement authority or regulatory body without prior notice to the subject of the report.

11. Privacy and data
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these terms by reference. The Privacy Policy explains how we collect, use, store, and share personal data, and your rights under UK data protection law.
12. Changes to these terms
We may update these terms from time to time. We will notify registered professionals of material changes by email at least 30 days before they take effect. For members of the public, the updated terms will be posted on this page with a revised "last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.
13. Governing law
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
